Liquor Sales Policy

1. About this Policy
This policy applies to all liquor sales facilitated through the ZingaMenu platform, operated by Aspire
Payment Pty Ltd trading as Zinga Pay (ABN 56 662 218 331) (“Zinga Pay”, “we”, “our”). It applies in
addition to the Zinga Pay Refund & Cancellation Policy and Delivery Policy.

Zinga Pay is a technology and payment facilitation service only. Zinga Pay does not hold a liquor licence
and does not sell, supply or deliver liquor. Each Merchant is solely responsible for holding the relevant
liquor licence(s) required under applicable Commonwealth, state or territory law, and for complying with
all liquor licensing obligations in connection with any sale or delivery of liquor through the platform.


2. Merchant Licence Requirements
A Merchant may only list and sell liquor through ZingaMenu where the Merchant holds a current and valid
liquor licence authorising the relevant type of sale (for example, an online or delivery liquor licence under
the applicable state or territory legislation). The Merchant’s liquor licence number is displayed on the
Merchant’s venue page on the platform.

Zinga Pay reserves the right to suspend or remove any Merchant’s liquor listings where it becomes aware
that a Merchant does not hold the required licence or is in breach of licensing conditions.


3. Age Verification — Checkout
The platform enforces an 18+ age confirmation at checkout for any Order that includes a liquor item.
Customers must confirm they are aged 18 years or over before payment is authorised for such an Order.

This platform-level confirmation is in addition to, and does not replace, the Merchant’s obligation to conduct in-person ID verification on delivery (see Section 4).


4. ID Verification and Delivery Obligations
For every liquor delivery, the Merchant or delivery partner is required to:
• Verify a valid government-issued photo ID confirming the recipient is aged 18 years or over
• Confirm the recipient is the person who placed the Order
• Sight that the recipient is in an unintoxicated condition
• Refuse delivery where any of the above conditions cannot be satisfied
Delivery of liquor to a person who is underage, intoxicated, or not the person who placed the Order is prohibited and may constitute an offence under applicable state or territory liquor legislation.


5. Refusal of Service
A Merchant or delivery partner must refuse to supply or deliver liquor where:
• The recipient appears to be under 18 years of age and cannot produce valid ID
• The recipient is or appears to be intoxicated
• There are reasonable grounds to suspect the liquor may be supplied to an underage person (secondary supply)
• The recipient is wearing a school uniform or is otherwise identifiable as a minor
• The delivery address is a school, childcare centre or other premises where supply would be unlawful
Where delivery is refused on any of the above grounds, the Order is non-refundable at the Merchant’s discretion, subject to the ACL.


6. NSW Same-Day Alcohol Delivery
In New South Wales, same-day alcohol delivery is subject to additional requirements under the Liquor Amendment (Alcohol Delivery Services) Act 2018 (NSW) and associated regulations, including but not limited to:
• Delivery must not commence before 10:00 am or after 11:00 pm
• Delivery must be to a residential or business address (not a public place)
• The Merchant must hold a licence authorising takeaway liquor sales
Merchants operating in NSW are solely responsible for compliance with all applicable NSW liquor delivery legislation and any conditions attached to their licence.


7. Contactless Delivery
Contactless delivery is not available for liquor or any other age-restricted items. All liquor deliveries require in-person handover, ID verification and assessment of the recipient’s condition as set out in Section 4.


8. Applicable Legislation
Liquor sales through the platform are subject to the liquor licensing laws of the state or territory in which the sale and delivery occur, including (without limitation):
• Liquor Act 2007 (NSW)
• Liquor Control Reform Act 1998 (VIC)
• Liquor Act 1992 (QLD)
• Liquor Control Act 1988 (WA)
• Liquor Licensing Act 1997 (SA)
• Liquor Licensing Act 1990 (TAS)
• Liquor Act 2010 (ACT)
• Liquor Act 2019 (NT)
Merchants are responsible for ensuring their operations comply with the specific requirements of the legislation applicable to their licence and the jurisdiction of delivery.
